These Terms govern your use of DeathCertificateCounsel.org and the administrative facilitation services we provide, including coordination of counselling sessions with independent lawyers for death-certificate related matters. Please read them carefully before submitting a request or making a payment.
Welcome to DeathCertificateCounsel.org (the "Platform"). These Terms and Conditions ("Terms") form a legally binding agreement between you ("User" or "Client") and Legal Fox India, the company operating the Platform ("Company", "we", "us", "our"). By accessing the Platform, submitting a request, or paying the Platform Fee, you confirm that you have read, understood and agree to these Terms, our Disclaimer and our Refund Policy.
Important Notice: The Company is an administrative facilitation and request-management service. We are NOT a law firm, and we do NOT provide legal advice, legal counselling, legal representation or any government service. We do NOT issue, register, correct or expedite death certificates. Any legal counselling is provided solely by an independent Lawyer, in his or her own professional capacity, directly to the User.
1.1 Company: Legal Fox India, the private entity that owns and operates DeathCertificateCounsel.org.
1.2 Platform: The website, forms, communication channels and software systems operated by the Company.
1.3 User / Client: Any person who visits the Platform or requests Services, including a family member, legal heir, nominee or authorised representative of a deceased person.
1.4 Lawyer: An independent advocate enrolled with a State Bar Council in India who has chosen to be available on the Platform and who acts in his or her own professional capacity.
1.5 Death-Certificate Matter: Any issue relating to registration of death, delayed registration, correction of entries, non-availability of records, reissue of a death certificate, or related documentation needed for claims, succession or record updates.
1.6 Services: Administrative request handling, general document checklist support, appointment-scheduling facilitation with a Lawyer (only on the User's request), non-legal document organisation, status tracking and communication support. Services expressly exclude legal advice, legal counselling, drafting of legal content, filing of applications, representation or advocacy.
1.7 Platform Fee: The fee charged by the Company solely for the Services described above (currently ₹2250, or such other amount as displayed at the time of payment).
1.8 Lawyer Fees: Any professional fees charged by a Lawyer for consultation, advice, drafting or representation, payable directly to the Lawyer under the Lawyer's own terms.
1.9 Business Hours: The working hours published by the Company, which may exclude weekends and public holidays.
The Platform operates strictly as an administrative facilitator and request-management support system. The Company does not practise law, does not render legal opinions, does not interpret legal provisions for Users, and does not draft legal content.
The Platform enables Users to request administrative assistance for scheduling and coordination with an independent Lawyer, if the User chooses to proceed. Any communications, checklists, templates or content published by the Company are for general administrative information only and are not legal advice. Requirements for death registration and certificates vary by State, local body and individual facts.
3.1 Appointment Facilitation (User-initiated): On the User's request and consent, the Company facilitates administrative coordination and scheduling with an independent Lawyer who is available on the Platform, based on the information the User provides at the time of the request. The Company does not recommend, endorse, rank, certify, select or assign any Lawyer.
3.2 Document Checklist & Organisation (Non-Legal): The Company may share a general checklist of commonly required documents and may help arrange documents for the Lawyer's review. The Company does not draft affidavits, applications, petitions, notices or any other legal instrument.
3.3 Communication Support / Virtual Number: The Company may provide system-generated communication channels or virtual numbers for privacy and operational convenience. Any call or communication by a Lawyer through such a channel is made in the Lawyer's independent professional capacity and not on behalf of the Company.
3.4 Request-Management Support: The Company may send reminders, coordinate schedules, collect non-privileged administrative information, and track basic status updates shared by the User or the Lawyer.
3.5 No Guarantee of Availability: The Company does not guarantee a Lawyer's availability, response time, acceptance of the interaction, or continued presence on the Platform. A Lawyer may accept or decline any interaction at his or her sole discretion.
3.6 Services Not Provided: The Company does not visit any registrar office, hospital, municipal body, court or police station, does not submit or follow up on applications with any authority, and does not pay government or court fees on the User's behalf.
The User acknowledges that the Platform Fee is payable solely for administrative facilitation and platform infrastructure. The Company does NOT collect, receive, hold, escrow or transfer any professional legal fees on behalf of any Lawyer, and does not bundle legal services into the Platform Fee.
Any payment made by the Company to a Lawyer (including any fixed administrative honorarium) is an internal commercial arrangement for availability and administrative coordination only. It is NOT linked to the number of Users, consultations, legal advice given, outcomes or the value of legal services. The User has no rights or claims in relation to such internal arrangements.
A binding contract for the Company's administrative Services is formed when the User submits a request and pays the Platform Fee, subject to the User confirming the request through the Company's confirmation email or registered channel, where the Platform requires it. No Lawyer-Client relationship is created by submitting a form or paying the Platform Fee.
Automated Commencement: Facilitation begins with automated system actions such as request logging, confirmation dispatch, queue allocation, availability mapping and internal workflow initiation, including outside Business Hours. These actions constitute commencement of Services for administrative purposes, even if an appointment time has not yet been communicated.
Lawyers are independent professionals. The Company does not supervise, direct or control any Lawyer's professional judgement, advice, strategy, conduct or performance, and is not responsible for any advice given, action taken or outcome produced by a Lawyer.
Any confidentiality or legal privilege exists only between the User and the Lawyer. Users should share privileged or sensitive legal facts directly with the Lawyer and not with Company staff.
Nothing in these Terms creates any agency, partnership, joint venture, employment or fiduciary relationship between the Company and any Lawyer. The Company cannot bind any Lawyer, and no Lawyer can bind the Company. The Company does not control the content of a Lawyer's communications and does not provide scripts or instructions for legal advice.
The Company does not recommend, endorse, rank, certify, rate or guarantee any Lawyer. The Platform does not assign Lawyers and does not solicit legal work on behalf of any Lawyer.
Where one or more Lawyers are available based on the User's details, the Platform may disclose such availability. Facilitation happens only on the User's explicit request and consent. The Company is not obliged to offer multiple Lawyer options.
DeathCertificateCounsel.org is a private platform. It is not a government website and is not associated with, authorised by or endorsed by any Registrar of Births and Deaths, municipal corporation, Gram Panchayat, hospital, court, the Office of the Registrar General of India, or any other government department.
Death certificates are issued only by the competent registration authority. Users may apply directly to that authority or through official government portals without using the Platform.
Nothing on the Platform is legal advice or a guarantee. Any decision to proceed with a Lawyer is made by the User independently. The Company does not guarantee the registration, issuance, correction or reissue of any death certificate, or any timeline, approval, success or result in any matter. All such decisions rest solely with the concerned authority.
10.1 Contact Attempts: After the appointment is confirmed, the Lawyer will make up to three (3) contact attempts using the User's registered mobile number and/or registered email ID. If the User does not answer, is unavailable, has a switched-off number, rejects calls or messages, faces network issues, has provided incorrect details or otherwise fails to respond, this will be treated as User non-responsiveness, and the Company shall have no liability.
10.2 Rescheduling Limit: A confirmed appointment may be rescheduled up to three (3) times. Once the User has used all three rescheduling chances, any fourth request will be treated as a new appointment, and the full Platform Fee will be payable again, with no adjustment or credit for the earlier fee.
10.3 No Refund for Non-Response: If the User misses or ignores contact attempts, does not respond to follow-ups, provides incorrect contact details or fails to coordinate within a reasonable time, the appointment may be treated as attempted, and no refund will apply.
10.4 Appointment Delay: In some circumstances, the Lawyer may be delayed in starting the scheduled call by up to three (3) hours from the appointed time. Such a delay does not by itself entitle the User to a refund.
10.5 Technical Issues: Where a session is missed because of technical failure, network disruption or any issue with either party's device or connectivity, neither the Company nor the Lawyer shall be responsible. Rescheduling in such cases is subject to mutual availability and Platform policy.
Refunds, if any, are governed strictly by the Refund Policy published on the Platform. Refund eligibility applies only to the Platform Fee and administrative Services. It does not cover Lawyer Fees or any third-party or government costs.
Refund Request Before Booking: A refund request raised after confirmation but before an appointment is booked will place the appointment on hold until the accounts department reviews and resolves it under the Refund Policy.
Chargebacks: If the User raises a chargeback or dispute through a bank, payment gateway or regulator, any refund may be paused until the dispute is resolved, subject to applicable law.
Goodwill Consideration: In exceptional circumstances, the Company may, at its sole discretion, offer a partial refund of up to 20% of the Platform Fee as a gesture of goodwill.
Failure to respond, incorrect details or non-cooperation may cause delays or closure of facilitation under Platform policy.
Users must not misuse the Platform. This includes providing false information or documents, seeking to obtain a certificate by unlawful means, abusing or harassing staff or Lawyers, sending threatening communications, repeated refund abuse, frivolous disputes, impersonation, any unlawful activity, or trying to obtain legal advice from Company staff. The Company may restrict access for such conduct without liability and may report unlawful activity to the appropriate authorities.
The Company processes personal data, including details of the User and the deceased person, for administrative facilitation, customer support, fraud prevention and legal compliance, in accordance with applicable Indian data protection law. The Company does not sell personal data to third parties.
By requesting facilitation, the User authorises the Company to share the necessary details with an independent Lawyer for that purpose. Calls and messages may be recorded for quality and compliance where the law permits, and notice may be given. By continuing communications after notice, the User consents to such recording to the extent the law permits. The User may stop communicating if he or she does not consent.
The Company is not liable for any advice given by a Lawyer, any action or inaction by a Lawyer or any authority, or any legal or administrative outcome. The Company's aggregate liability, if any, is limited to the Platform Fee the User paid for the specific request that gave rise to the claim.
To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special, consequential or punitive damages, loss of profits, loss of data, loss of claims or benefits, or reputational harm.
The User agrees to indemnify and hold harmless the Company and its personnel against all claims, losses, liabilities, costs and expenses (including reasonable legal fees) arising from the User's breach of these Terms, misuse of the Platform, submission of false information or documents, unlawful conduct, or any dispute between the User and a Lawyer.
The Company may update these Terms from time to time, and the "Last updated" date above will change when it does. Continuing to use the Platform after an update means the User accepts the revised Terms. The Company may suspend or restrict access for security, compliance, fraud prevention, operational reasons or misuse.
The Company is not liable for delay or failure in performance caused by events beyond its reasonable control, including network or power failures, outages, government actions or restrictions, office closures of authorities, natural disasters, epidemics, strikes, or third-party service disruptions.
These Terms are governed by the laws of India. Subject to the User's non-waivable rights under consumer protection law, courts at Jhunjhunu, Rajasthan shall have exclusive jurisdiction.
Any dispute arising out of these Terms may be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Jhunjhunu, Rajasthan, and proceedings shall be in English or Hindi. This is subject to the User's rights under consumer protection law where those rights cannot be waived.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions stay in full force. Provisions on payment nature and separation, disclaimers, limitation of liability, data protection, indemnity, governing law and dispute resolution survive termination or completion of the Services.
